10.1The customer immediately reports any damage, defect or loss of a part or equipment and stops using the item if continuing could be dangerous or increase the damage.
10.2Special attention must be paid to the tyres and rims, glass, mirrors, roof, underbody, van side panels, coupling device, loading ramps and low-lying parts. The customer must take into account height, width, length, ground clearance and turning radius. Photographing the roof is not mandatory.
10.3The customer is liable for proven damage arising during the rental period as a result of their actions, negligence or the actions of a driver they have approved, excluding normal wear, previous damage, a technical defect not caused by the customer, or circumstances for which the customer is not responsible under law.
10.4If insurance covers the damage, the deductible is 1 500 € for passenger cars, 2 000 € for vans and 800 € for trailers and car carriers per damage event. If insurance does not cover the damage or covers it only partially, the customer compensates the proven damage not covered by insurance for which they are liable, up to a maximum of 900 € per damage event. The total amount charged for the damage itself, including the deductible and the part not covered, is at most the item's deductible or 900 €, whichever is greater. If the proven damage is smaller, the customer pays the smaller amount. An insurance company's negative decision alone does not prove the customer's liability. The downtime under section 10.7 and towing under section 12.3 are calculated separately. The same amount must not be charged twice.
10.5Once AutoFox has sufficient information about the cause of the damage and the amount claimed, it notifies the customer without undue delay. AutoFox provides the available evidence: photos, a calculation, an invoice, the insurance decision or other documents.
10.6AutoFox may claim compensation for proven damage even if the vehicle has not yet been repaired. The amount is demonstrated with a reasoned cost estimate, an independent assessment or other documents concerning the actual damage. Previous condition, wear, depreciation, insurance and the customer's liability are taken into account. A cost estimate is not an invoice for a repair already done. The same amount must not be charged twice from the customer, the insurance company or another person.
10.7If the vehicle cannot be rented out because of proven damage caused by the customer, the customer pays for the necessary downtime at the daily rate of that vehicle. The rate is the price in force on AutoFox's website at the time of booking and shown to the customer, recorded in the booking confirmation. Calculation: daily rate × documented length of downtime in days. Partial days are calculated pro rata. AutoFox demonstrates the cause and duration of the downtime with documents. Delays caused by AutoFox or time during which the vehicle was already rentable are not charged. Compensation received from insurance or another party for the same downtime is deducted.
